    the way he is going to drive. he only looks right and pulls out. i manage to slow down for no major accident but a bump is involved who is at fault. me or the driver who pulled out.

    was passing allowed on the road you were on? if so, it is the other cars fault for failure to yield right of way. if passing was not allowed, it would be your fault or the insurance company may put comparitive negligence on other driver and find you majority at fault.

    these sort of issues are normally resolved by a proportion of blame as a percentage. best case scenario is 50% fault on both parties. you for overtaking nera a road junction and them for pulling out without proper cheching for road traffic.
    it would most likely end up with a pay for your own damage case. ift its only a small bump put it down to experience and pay for your own repairs.Unless teh other driver admitted laibility then you can push for a better sttelment.
